Terms of Use for Zircon3D by Lichr

Last Updated: March 29, 2026

These Terms of Use ("Terms") govern your access to and use of Zircon3D and related websites, applications, hosted services, downloadable components, documentation, and support channels provided by Lichr Inc. ("Lichr", "Company", "we", "us", or "our"). Zircon3D is a 3D visualization platform for buildings, facilities, smart homes, and monitored environments, including integrations with third-party systems such as Home Assistant and deployment options that may include cloud, on-premise, or hybrid environments.

By creating an account, starting a trial, purchasing a paid plan, installing or using Zircon3D, or otherwise accessing the Service, you agree to these Terms. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility and Accounts

You must be legally able to enter into a binding contract to use the Service. If you create an account, you must provide accurate and current information and keep it updated.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activities that occur under your account;
  • promptly notifying us of any unauthorized access to or use of your account.

We may suspend or restrict access to an account that appears to be compromised or used in violation of these Terms.

2. Service Overview

Zircon3D helps users create and manage interactive 3D floor plans, buildings, and site layouts, visualize real-time or historical data, and connect supported monitoring systems and devices.

The Service may include free plans, paid subscriptions, trials, community resources, documentation, demos, integrations, downloadable tools, and enterprise offerings. Certain features, limits, deployment options, support levels, and commercial terms may vary by plan, order form, or separate written agreement.

3. Acceptable Use

You may use the Service only in compliance with these Terms and applicable laws. You must not:

  • use the Service for unlawful, fraudulent, or infringing purposes;
  • interfere with or disrupt the integrity, security, performance, or availability of the Service;
  • attempt to gain unauthorized access to accounts, systems, networks, or data;
  • reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except to the extent such restriction is prohibited by law;
  • copy, resell, sublicense, lease, or exploit the Service except as expressly permitted by us in writing;
  • bypass plan limits, technical restrictions, access controls, or usage quotas;
  • upload, transmit, or integrate any content, code, or device data that violates law, infringes rights, or contains malicious code;
  • use the Service in a way that could harm other users, third-party systems, or our business operations.

4. Customer Data and User Content

As between you and Lichr, you retain ownership of the data, content, layouts, project materials, device mappings, and other materials you submit to or process through the Service (collectively, "Customer Data").

You grant us a non-exclusive, limited right to host, process, transmit, store, back up, display, and otherwise use Customer Data solely as necessary to provide, maintain, secure, support, and improve the Service, and to comply with applicable law.

You are responsible for ensuring that you have all rights, permissions, and consents needed for your Customer Data and for your use of any connected devices, buildings, plans, images, or third-party systems.

5. Privacy and Security

Our handling of personal information is described in our Privacy Policy. You are responsible for configuring and using the Service in a manner appropriate for your environment, including your own devices, networks, integrations, credentials, and access permissions.

While we use reasonable measures to protect the Service, no software or online service can be guaranteed to be completely secure, uninterrupted, or error-free.

6. Integrations and Third-Party Services

Zircon3D may interoperate with third-party services, devices, platforms, or content, including Home Assistant and other monitoring systems. Your use of third-party services is governed by your agreements with those third parties, not by these Terms.

We are not responsible for third-party products or services, including their availability, accuracy, security, changes, or acts or omissions. Integrations may be modified, suspended, or discontinued at any time.

7. Plans, Trials, Billing, and Payment

Some parts of the Service are offered free of charge, and some require payment. Public pricing, usage limits, and plan descriptions may be posted on zircon3d.com/pricing or otherwise presented during checkout, activation, or sales discussions.

For paid plans:

  • fees are charged based on the plan and billing cycle you select;
  • unless otherwise stated, fees are payable in advance and are non-refundable except as required by law;
  • you must provide complete and accurate billing information and keep it current;
  • we may use third-party payment processors to bill and collect payment;
  • applicable taxes, duties, or similar governmental charges may be added unless expressly stated otherwise.

If we offer a free trial or promotional plan, the specific eligibility, duration, conversion, and cancellation terms for that offer will be presented when the offer is activated.

We may change plan features, limits, or pricing prospectively. If a change materially affects an existing paid subscription, we will use reasonable efforts to provide advance notice.

Enterprise services may be subject to a separate order form, statement of work, master services agreement, or other written agreement. If there is a conflict between these Terms and a separate signed agreement, the signed agreement controls for that conflict.

8. Suspension and Termination

You may stop using the Service at any time. We may suspend, limit, or terminate your access to all or part of the Service if:

  • you breach these Terms;
  • payment is overdue;
  • your use creates security, legal, or operational risk;
  • we are required to do so by law or a lawful request;
  • we discontinue the relevant Service offering.

Termination does not relieve you of payment obligations accrued before termination. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity, governing law, and disputes.

9. Intellectual Property

The Service, including its software, design, user interface, trademarks, branding, documentation, site content, and all related intellectual property rights, is owned by Lichr or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms and your applicable plan, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal personal or business use.

Except as expressly permitted by these Terms or by applicable law, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, publicly perform, or create derivative works from the Service.

10. Feedback

If you provide suggestions, ideas, comments, or other feedback regarding the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or obligation to you.

11. Service Changes and Availability

We may modify, improve, suspend, or discontinue any part of the Service, including features, integrations, support channels, pricing structures, plan limits, or availability, at any time.

We will use reasonable efforts to provide advance notice for material changes when reasonably practicable, but we are not obligated to maintain any specific feature, integration, or compatibility indefinitely.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. Lichr and its licensors disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, error-free, secure, accurate, compatible with every device or environment, or that defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, Lichr and its directors, officers, employees, affiliates, contractors, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or business interruption, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the aggregate liability of Lichr arising out of or related to the Service or these Terms will not exceed the greater of: (a) the total amount you paid to Lichr for the Service during the 12 months before the event giving rise to the claim; or (b) 50 USD.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Lichr and its affiliates, officers, directors, employees, contractors, and licensors from and against third-party claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your Customer Data;
  • your misuse of the Service;
  • your breach of these Terms;
  • your violation of applicable law or the rights of a third party.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Prince Edward Island and the applicable federal laws of Canada, without regard to conflict of laws principles.

You and Lichr agree that the courts located in Prince Edward Island, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law does not permit that choice of forum.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Service and may also provide notice by email, account notice, or other reasonable means.

Unless otherwise stated, updated Terms become effective when posted. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms.
